TERMS
AND CONDITIONS OF SALE
In the
following conditions, the "Seller' means Pinckney Green Stoneworks,
and the 'Buyer means the person buying the product from the "Seller'.
The statutory rights of the buyer are not affected by these conditions.
These conditions shall apply to all contracts unless expressly varied
in writing by the seller. Any inconsistencies to Seller's terms,
offered on behalf of the buyer shall be assumed to be void unless
accepted by the seller, in writing.
1. PAYMENT TERMS:
a) The Seller reserves the right to ask the Buyer for a deposit
or advance payment of half the total price before the Buyer's order can be processed.
b) The balance of each order is to be paid in full in cash (not cheques) upon delivery.
2. DELIVERY:
a) Delivery dates quoted are genuine forecasts but shall not
be legally binding on the Seller.
b) Time of delivery shall not be the essence of any contract.
c) In the event of the Seller being unable to supply goods subsequent
to receiving an order from the Buyer, the Seller shall not be liable
for any incidental or consequential loss howsoever arising.
d) The Seller recommends that the buyer checks
description of goods on delivery. In the event of
any discrepancy the buyer must notify the Seller at the time of delivery, before the goods are processed
in any way. Otherwise no responsibility can be accepted for any
claims.
e) In all events the limits of liability for any fault or defect
in the product shall be to a sum not exceeding the purchase price
of the particular goods, and the Seller shall not be liable for
any losses arising.
f) The Seller will not accept any liability for delays caused by
'force majeure' beyond the Seller's control.
3. RETURNS:
a) The Seller reserves the right of discretion, to accept or to
refuse the return of any goods supplied.
b) Goods returned must returned in good condition and for the stated reason.
4. RISK AND TITLE:
a)Rick in the Goods passes to the Buyer on delivery.
b) Goods shall remain the sole and absolute property of the Seller as legal
and equitable owner, until the Buyer has paid to the Seller the
total agreed price.
c) The Seller may for the purpose of recovery of his goods enter
any premises where they are stored or where they are reasonably
thought to be stored and reposes them.
5. CANCELLATION:
a) In the event of cancellation of any order by the Buyer, the Buyer
will be responsible for all costs incurred by the Seller up to the
point of cancellation.
b) The Buyer must notify the Seller of any cancellation in writing.
